In a significant legal victory, Mr. Mohammed Mustapha has been awarded GH₵ 3 million in damages by an Accra High Court following a lawsuit against Ridge Hospital.
The case, which centred on allegations of medical negligence, stems from the tragic death of Mr. Mustapha’s wife, Akua Nyarko Osei-Bonsu, and their baby in December 2019.
Mr. Mustapha had filed the lawsuit in June 2020, seeking GHC 5 million in damages. The suit alleged that Ridge Hospital’s medical team failed to adequately manage Mrs. Osei-Bonsu’s condition during and after a Caesarean Section (CS). According to the lawsuit, a critical post-surgical medication was not administered.
The complaint highlighted the failure of the hospital staff to provide prophylactic anticoagulant therapy, which is standard practice following CS. The complaint claimed that this omission directly contributed to the development of thromboembolism, which ultimately led to the deaths of Mrs. Osei-Bonsu and her baby.
The court’s decision to award GH₵ 3 million in damages acknowledges the negligence alleged in the case and provides compensation for the loss suffered by Mr. Mustapha.
Following the court’s decision, Mr. Mustapha took to Facebook to announce the outcome.
He wrote:
“The Accra High Court today held that Ridge Hospital was negligent in the case of my late wife Akua Nyarko Osei-Bonsu. Damages were issued and all pleadings were upheld. Four years have been a real legal battle, and my biggest and profound gratitude goes to my friend and counsel Yaw Twumasi Ankrah, Beatrice Annan, and all their able lawyers who believed in and pushed for this outcome. CASE CLOSED,” he posted.
This ruling underscores the importance of adhering to medical standards and protocols in patient care.
